Smith, Tozian, Daniel & Davis P.A., represents Florida lawyers, judges and Bar applicants. As private ethics counsel, we help lawyers create risk management strategies to reduce law firm exposure or provide guidance before a Bar complaint is filed. We conduct trust account check-ups, draft ethics opinions and assist lawyers with marketing and advertising compliance. We also work with lawyers outside of Florida to evaluate Florida multi-jurisdictional practice issues.

We offer law school and Florida Bar Application review and guide Bar applicants through the character and fitness investigation, whether it reviewing a law school or Florida Bar application before it is filed, helping respond to a Board of Bar Examiner request for information or representation at an investigative or formal hearing.

We have extensive experience defending lawyers and county, circuit and district court judges throughout the disciplinary process. Most lawyers and judges choose to retain us to submit the initial response to a Bar complaint or respond to a Judicial Qualification Rule 6(b) Notice but we litigate all stages of the disciplinary process, including grievance committee investigations, Referee trials or Judicial Qualification Rule 7 Panel hearings as well as review before the Florida Supreme Court.

About Us

Donald A. Smith, Jr., and Scott K. Tozian began their legal careers in 1978 prosecuting attorney disciplinary cases on behalf of The Florida Bar before becoming Assistant State Attorneys for the Thirteenth Judicial Circuit in 1981. Scott and Don opened the firm of Smith & Tozian, P.A. in 1983.

Gwendolyn H. Daniel joined the firm as an associate attorney in 1998, after working as an Assistant State Attorney for the Thirteenth Judicial Circuit. In 2005, Gwen became a partner and Debra J. Davis joined the firm as an associate attorney. As a Certified Public Accountant, Debbie first worked for The Florida Bar as a trust account auditor before working as a Florida Bar prosecutor for nine years. In 2013, Debbie became a partner and Smith, Tozian, Daniel and Davis, P.A. was formed.
